श्री गोपाल गोडसे ,श्री विष्णु रामकृष्ण करकरे ,श्री मदनलाल पहावा ,इन तीनो को गाँधी – हत्या अभियोग में आजन्म करवास हुआ था |ये तीनो बंदीगृह से 13 अक्तूबर 1964 को मुक्त हुए | एक माह पश्चात् पूना के मित्रगणों ने उनकी रिहाई की ख़ुशी में पूजा का आयोजन किया था |उस पूजा समारोह में गजानन विश्वनाथ केतकर भी सम्मलित हुए थे जो एक प्रसिद्ध पत्रकार और केसरी समाचार पत्र के संपादक भी रहे है उन्होंने गाँधी जी की हत्या को टालने के लिए शासन को सूचित भी किया था ,उनकी इस सूचना पर हिन्दू विरोधी समाचार पत्रों ने बड़ा ही शोर मचाया था शासन ने दस –बारह लोगो को भारत प्रतिरक्षा नियम के तहत जेल भी भेजा जो एक वर्ष बाद छूटे | यही कारण था की कपूर आयोग का जन्म हुआ अपनी रिपोर्ट में न्यायधीश कपूर ने इस बात की चर्चा भी की थी | कि गाँधी हत्या का पूर्वाभास किस -२ को था | जब मुक़दमा चला उस समय जे.सी. जैन ने न्यायाधिश के सामने सन १९४८ में गवाही दी थी कि मदनलाल पाहवा ने उस सडयंत्र के बारे में उनसे कुछ कहा था इस गवाह के कथन के अनुसार किसी की भी इच्छा नही थी कि गांघी जी को बचाया जाये | इस आयोग के निर्माण का खोज क्षेत्र सिमित था इस सीमा में इस गवाही का यह भाग बहुत महत्वपूर्ण था उन्होंने कहा “ मेरी जितनी शक्ति थी मैंने लगा दी | मैंने मुंबई राज्य के मुख्य सचिव जय प्रकाश और हँरिस को भी बताया था इससे अधिक मै और कर भी क्या सकता है मुझसे जो बन सका वो मैंने किया इनमे से किसी ने भी कोई हरकत नही किया यह मेरा दोष नही है “जैन ने प्रा. याज्ञिक को बताया था याज्ञिक रामनारायण रुइया महाशाला में एक प्राध्यापक है उन्होंने भी गवाही दी है उनकी यह गवाही 29 थी जब जैन ने याज्ञिक को मदनलाल के कार्यक्रम के विषय में बताया तो उन्हें इस बात पर भरोसा ही नही हुआ | उन्होंने जैन से उस विषय में शासन को सूचित करने के लिए कहा भी था| न्यायमूर्ति श्री कपूर ने प्रतिव्रत के प्रष्ट 169 पर लिखा है जैन को गाँधी जी के जीवन को खतरा है इस बात का पूर्वज्ञान था | यह बात जैन ने अपने मित्रो से कही थी , किन्तु उन्होंने इस बात पर गंभीर रूप से नही सोचा, परन्तु इस आयोग का यह मत है कि श्री जैन को पुलिस अधिकारी नागरवाला या भरुचा से मिलने में कुछ संकोच था तो उन्हें इया बात को मंत्रियो अथवा कांग्रेस के नेताओ को अथवा चीफ प्रेसिडेंट मजिस्ट्रेट को बतानी चाहिए थी ,वह उनका कर्तब्य था | स्व. बालूकाका कानिटकर उस समय के कृषक श्रमिक पक्ष के कार्यकर्त्ता श्री र. के. खाडिलकर सांसद स्व . केशवराव जेघे और श्री ग. वि. केतकर आदि अपदाधिकारी व्यक्तियों को यह पता था कि पूना का माहौल गाँधी जी के लिए ठीक नही है सार्वजानिक ब्यास्पीठ के भाषण ,व्यक्तियों के बात चीत इन सबमे कांग्रेस के वरिष्ठ नेता विशेषकर महात्मा गांघी नेहरू ,सरदार पटेल मौलाना आजाद के जीवन को हानि पहुचाने के संकेतो की अभिव्यक्ति होती थी इस बात का ज्ञान उपरोक्त सज्जनों को था | इस लोगो में से स्व. बालुकाका कानिटकर और भागवत ने ही केवल मुंबई के ,मुख्यमंत्री श्री खेर और उपप्रधानमंत्री सरदार पटेल को सूचित किया था किन्तु उन्होंने पुलिस अधिकारियो को नही बताया था न्यायधीश कपूर आगे कहते है कि इस तथ्य की छानबीन करने के लिए किसी ने भी ख़ुफ़िया विभाग से सम्पर्क ही नही किया यह आश्चर्यजनक बात है श्री केशवराव जे थे ने गाडगिल से जो बात कही थी उसको छोड़कर उन्होंने और कोई स्पष्टीकरण नही दिया | ऐसा न्यायमूर्ति प्रतिवृत्त खण्ड २ अनुच्छेद 121 – ३० से स्पष्ट होता है | प्रष्ट 130 पर अनुच्छेद 21 -34 में लिखा है “श्री काका गाडगिल तब केन्द्रीय मंत्री थे | वे पूना के एक प्रमुख नागरिक थेउन्होंने सन 1964के धनुर्धारी के दीपावली अंक में एक लेख लिखा है उसमे वे कहते है कि पंजाब और बंगाल के हिन्दुओ पर विभाजन के कारण जो आपत्ति आई उस कारण महात्मा गाँधी के विरुद्ध लोकमत क्रुद्ध था |पूना में गाँधी जी के विरुद्ध बड़ी कठोर भाषा का प्रयोग खुले आम होता था |पूना के समाचार पत्रों ने गाँधी जी की आलोचना कर हिंसावाद को अप्रयत्क्ष रूप से बढ़ावा दिया था | कोई न कोई भयानक घटना होने वाली थी इस प्रकार एक कहानी भी कान में आती थी कि बालूकाका कानिटकर ने बालासाहेब खेर को एक गुप्त पत्र लिखा है ऐसा सुनने मेंआता था कि उस पत्र में श्री कानिटकर ने लिखा था कि गाँधी जी के विरुद्ध कुछ षड्यंत्र पक रहा है | सरदार पटेल कभी –कभी चिंता व्यक्त करते थे किन्तु उसकी ओर गंभीरतापुर्वक ध्यान नही दिया जाता था |नेहरू हिन्दू नेतागणों के खिलाफ आग उगलते थे|गाडगिल आगे लिखते है “ निर्वासितो की भावना थी कि गाँधी उनके लिए भी कुछ करे अपितु वे केवल मुसलमानों की सहायता करते थे क्योंकि वे अपने प्राथानोत्तरभाषण भाषण के पश्चात् गाँधी जी केवल हिन्दुओ के कृत्यों की आलोचना करते थे उनके इस व्यवहार से काफी हिन्दू नाराज थे 44 करोड़ रुपये का अनुदान उनके लिए जले पर नमक जैसा था गाँधी जी जो भाषण करते थे और नेहरूहिन्दुओ के खिलाफ जो बोलते थे उससे गाँधी जी के विरुद्ध माहौल दिन – प्रतिदिन विषाक्त हो रहा था स्व. गाडगिल को इस घटना का जो पूर्वज्ञान था उस विषय में न्यायाधीश कपूर ने कहा है कि जेघे का कहना ठीक –ठीक क्या था ,इनकी छानबीन गाडगिल को करनी चाहिए थी मदनलाल ने जो स्वीकार किया था उसके अनुसार गाडगिल ने इस बात को गंम्भीरता से लेने का प्रयास नही किया इसीलिए गोपाल गोडसे ने अपनी गवाही में न्यायाधीश कपूर से कहा था कि यदि हम सभी षडयंत्रकारी पकडे भी जाते तो भी गाँधी जी की हत्या टलना संभव नही दिखता था गाँधी – हत्या का माहौल बन चुका था ऐसा पूर्वज्ञान वरिष्ठ प्रशासनिक अधिकारियो का था परन्तु इस जानकारी पर भी कार्यवाही करने के लिए वे असमंजस में रहे | क्योकि वे जानते थे कि गाँधी हत्या सुनिश्चित है
